Terms of Service

1. Acceptance of Terms

WefixSound ("we", "our", "us") provides professional audio restoration services via wefixsound.com and app.wefixsound.com (the "Platform"). By registering an account, accessing the Platform, or submitting audio for restoration, you ("Client") unconditionally accept and agree to these Terms of Service in full. Acceptance is effective at the moment of registration — no additional signature or affirmative act is required.

If you do not agree with any part of these Terms, you must not create an account or use the Platform. Continued use of the Platform following any update to these Terms constitutes your acceptance of the revised Terms.

We may update, amend, or replace these Terms at any time and at our sole discretion, without prior notice. The current version is always available at wefixsound.com/terms and is identified by its "Last updated" date. Where we consider a change material, we will make reasonable efforts to notify registered users by email, but we are not obligated to do so for minor or clarifying amendments. It is your responsibility to review these Terms periodically.

2. Service Description

WefixSound offers human-performed audio restoration including, but not limited to: noise removal, voice clarity enhancement, vinyl and tape restoration, podcast cleanup, film audio restoration, and archive digitization.

Each project begins with a free sample: we process a short representative clip (typically 30–60 seconds) at no charge. You pay only after approving the sample and the quoted price for the full project.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must be at least 18 years old to use the Platform.

Each person may maintain only one active account. Creating multiple accounts to circumvent restrictions, obtain additional free samples, or evade a suspension is strictly prohibited and will result in the termination of all associated accounts.

4. Payments

Payment is processed via PayPal. By approving a quote and proceeding to checkout, you authorise the charge of the quoted amount.

All prices shown are in USD unless otherwise stated. Applicable taxes are calculated at checkout based on your location.

5. Refunds & Satisfaction Guarantee

Our refund policy is described in detail on our Refund Policy page. In summary: you never pay unless you have approved a sample. Once payment is made for a full project, refunds are available within 7 days if the delivered file materially fails to meet the agreed restoration scope. 6. Intellectual Property, Ownership & Client Responsibility

By submitting audio files to the Platform, you represent and warrant that:

• You are the owner of the audio, or you hold all necessary licences, rights, consents, and permissions to submit the audio for processing
• The submission and restoration of the audio does not infringe any copyright, neighbouring right, moral right, trademark, or other intellectual property right of any third party
• You have obtained all required clearances from any featured performers, rights holders, or collecting societies where applicable

You bear sole and full responsibility for ensuring that the audio you submit does not infringe the rights of any third party. WefixSound acts solely as a service provider processing files at your direction and is not responsible for verifying the ownership or licensing status of submitted material. Any claim, demand, loss, or liability arising from a third-party intellectual property claim relating to audio you submitted shall be your responsibility entirely.

You agree to indemnify, defend, and hold harmless WefixSound and its staff from and against any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your breach of the representations in this section.

You retain all intellectual property rights to audio files you submit. By submitting files, you grant WefixSound a limited, non-exclusive, revocable licence to process your audio solely for the purpose of providing the restoration service. We will not share, sell, distribute, or use your audio files for any other purpose. Files are deleted from our servers upon request or after 90 days following order completion, whichever comes first.

7. Prohibited Conduct

You must not use the Platform in any manner that violates these Terms or applicable law. Prohibited conduct includes, but is not limited to:

• Submitting audio that infringes any third-party intellectual property rights
• Submitting audio you do not have the legal right to reproduce, distribute, or modify
• Submitting audio containing illegal content under applicable law
• Submitting audio intended for use in fraud, harassment, or any unlawful activity
• Sending abusive, threatening, harassing, or offensive messages to our engineers or support staff via the Platform's chat or any other communication channel
• Engaging in spamming, flooding, or any behaviour that intentionally or unreasonably burdens the Platform's infrastructure
• Repeatedly submitting orders, requesting free samples, or initiating projects with no genuine intention to proceed to payment
• Creating multiple accounts to obtain additional free samples, circumvent pricing, evade a suspension, or otherwise abuse the Platform
• Initiating fraudulent chargebacks or payment disputes without first contacting us to resolve the issue
• Impersonating another person or misrepresenting your identity or affiliation
• Attempting to probe, scan, or test the vulnerability of the Platform or any related system

We reserve the right to determine, in our sole discretion, whether conduct constitutes a violation of this section.

8. Free Sample — Fair Use

The free sample is provided in good faith as a quality demonstration before payment. It is not intended to be used as a free partial restoration service. We reserve the right to decline further free samples or restrict access to the Platform for accounts that systematically request samples without proceeding to payment, or that we reasonably believe are exploiting the sample process.

Attempting to exploit the free sample offer by creating multiple accounts, using disposable email addresses, or any other means constitutes a material breach of these Terms and will result in permanent suspension of all associated accounts.

9. Account Suspension & Termination

We reserve the right to suspend, restrict, or permanently terminate your account at any time, with or without prior notice, if we reasonably determine that:

• You have violated any provision of these Terms
• Your conduct is abusive, fraudulent, or harmful to WefixSound, its staff, or other users
• You have initiated an unjustified chargeback or payment dispute
• You have created multiple accounts in violation of Section 3
• Continued provision of service to you poses a legal or reputational risk to WefixSound

Upon termination for cause, we are not obligated to refund any amounts paid for orders that were completed or in active progress at the time of suspension. We are not liable for any loss or inconvenience resulting from account suspension carried out in accordance with these Terms.

We also reserve the right to refuse service to any person for any reason not prohibited by law, including without obligation to provide an explanation.

10. Limitation of Liability

Audio restoration is a skilled craft applied to degraded source material. The quality of the restored output is inherently limited by the condition of the original recording. WefixSound does not guarantee any specific outcome, and results may vary depending on the severity of damage, recording medium, age, and storage history of the source material. Where material limitations are identified before work begins, we will communicate them to you prior to payment.

WefixSound's total liability for any claim arising from the use of the Platform shall not exceed the amount paid by you for the specific order giving rise to the claim. Under no circumstances shall WefixSound be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or reputational harm, even if advised of the possibility of such damages.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by applicable law.

11. Dispute Resolution

Before initiating any formal legal proceedings, you agree to contact us at hello@wefixsound.comand provide at least 30 days for us to resolve the dispute in good faith. This pre-action notice requirement is a condition precedent to any claim.

To the maximum extent permitted by applicable law, you agree that any dispute arising from or relating to these Terms or the Platform shall be resolved on an individual basis only. You waive any right to bring or participate in any class action, collective action, or representative proceeding against WefixSound.

These Terms are governed by and construed in accordance with applicable law. Any disputes not resolved amicably shall be submitted to binding arbitration or the competent courts in the jurisdiction of WefixSound's registered business location.
